The purchase of this ticket by the passenger named herein shall be deemed to be an unconditional acceptance of the following conditions:

On Carriage of Cargoes

1. Non-Transferability
This ticket is non-transferable and shall be used solely by the passenger named herein. As such, passenger is required to present a valid ID together with the printed itinerary receipt/E-ticket upon check-in.

 

2. Validity
This ticket is valid only for the voyage indicated herein and shall be deemed automatically cancelled if not used on the said voyage. If the passenger was, for any reason, unable to travel on the specified voyage, the ticket may still be refunded or revalidated (rescheduled) within sixty (60) days from the voyage departure date, subject to surcharges.

 

3. Passenger Check-in
Passenger must be at the passenger terminal for check-in at least two (2) hours before departure time. Trans-Asia Shipping Lines, Inc. reserves the right to cancel the ticket and accommodation of any passenger who fails to check-in thirty (30) minutes before scheduled departure and to issue the same accommodation to another passenger.
o Passengers must present valid identification at the check-in counter for verification. The following are acceptable forms of identification:
1. Driver’s license
2. Passport
3. School ID
4. Senior Citizen ID
5. Postal ID
6. SSS / GSIS / Unified government ID
7 PRC ID
8. Voter’s ID
9. NBI Clearance
o Passenger must present a printout of the PDF ticket upon check-in.
o Gender and age information are required by Philippine Maritime Law. Students, Senior Citizens, Disabled, Starsy members and other discounted tickets are required to present applicable ID. Discount will be forfeited if proper identification is not presented upon check-in.

 

4. Compliance of Rules and Regulations
The passenger undertakes to faithfully comply with the rules and regulations of the vessel particularly those involving the maintenance of peace and order, safety, and sanitation on board the vessel.

 

5. Liability of the Carrier
The passenger voluntarily agrees that Trans-Asia Shipping Lines, Inc. shall not be liable for death, injury, or delay to the passenger and/or loss, damage, or delay to the passenger’s baggage arising from any and all forms of fortuitous events, navigational safety requirements, and other causes beyond the control of Trans-Asia Shipping Lines, Inc. It is agreed that the term “baggage” shall mean only such property that is necessary for the personal use of the passenger during the voyage, excluding all money, jewelry, merchandise, securities, and other articles of similar nature for which Trans-Asia Shipping Lines, Inc. shall not be liable unless transported under a Bill of Lading. The liability of Trans-Asia Shipping Lines, Inc. in case of loss, damage, or delay to the passenger’s baggage shall be limited to five hundred pesos (Php 500.00) for first class passengers and a reduced proportion thereof in the case of all other passengers. Trans-Asia Shipping Lines, Inc. shall have no liability whatsoever for the loss of life or bodily injury or any other loss, damage, or delay in connection with this voyage unless a written notice of claim is presented to Trans-Asia Shipping Lines, Inc. within thirty (30) days or unless a suit is instituted within ninety (90) days from the day the passenger disembarks or from the day the vessel arrives at the passenger’s port of destination, whichever is earlier.

 

6. Baggage Allowance
2nd Class and Tourist class passengers can bring (2) 0.05 cubic meter in size of baggage on board. Private Room and Cabin passengers have double the allowance in terms of quantity but not in size. Allowance for minor passengers is half in size of that of an adult. Baggage in excess of the allowance will be deemed as cargo and will be treated as such and charged accordingly.

 

7. Pets
Pets and animals must be secured in cages and covered with necessary permit to transport. The passenger agrees to place their pets at the designated area on board the vessel.

 

8. Plants
Plants must also be covered with the necessary permits to transport.

 

9. Right to Refuse Boarding
Trans-Asia Shipping Lines, Inc. reserves the right to refuse boarding to a passenger and/or his baggage under the following conditions:
1. If the passenger and/or his cargo may pose a threat to the security, order, safety, health, or materially affect the comfort of other passengers and the vessel;
2. If the passenger has partially paid but refuses or fails to pay the fare balance, or payment is made through fraudulent means;
3. If the itinerary receipt or E-ticket is counterfeit or was fraudulently obtained, or has been altered by anyone other than the shipping line or its authorized agents, or has been defaced or mutilated;
4. If the passenger cannot prove or sufficiently establish upon check-in to vessel personnel’s satisfaction that he is the person named in the itinerary receipt or E-ticket.
5. If the passenger’s mental or physical state, serious illness, pre-existing medical condition, attitude or demeanor, including his intoxication or impairment from alcohol and drugs poses a hazard to himself, to other passengers, to crew or to property;
6. If the passenger has committed misconduct at the departure terminal or onboard the vessel prior to departure, including physical and verbal abuse against vessel crew, company representatives or other passengers and the Carrier believes that the conduct may be repeated;
7. If the passenger refuses for any reason whatsoever to submit to a security check at the passenger terminal or at the vessel gang plank prior to boarding.

 

10. Misconduct En Route
Carrier may take any measure as it deems reasonably necessary, including the use of physical restraint if the passenger’s conduct onboard endangers the vessel, other passengers, or property onboard or hinders the crew in the performance of their duties or if the passenger uses any threatening, abusive or insulting words towards the crew or behaves in a manner that causes discomfort, inconvenience, damage or injury to other passengers onboard. The carrier will hold the passenger liable for all costs, damages and liabilities that the company may incur as a result of such misconduct.

 

11. Sick Passengers
Upon check-in, sick passengers must present a medical certificate dated at least 5 days within the departure date attesting to their fitness to undertake sea travel. Otherwise, Trans-Asia Shipping Lines, Inc. reserves the right to deny their boarding. Non-ambulatory cases, especially those requiring life support, must be accompanied by a licensed nurse or doctor companion. Necessary medications or medical equipment is required to be brought as needed by the sick passenger for the duration of the voyage. The passenger confirms the authenticity of the said medical certificate and the truthfulness of the contents thereof; otherwise, Trans-Asia Shipping Lines, Inc. shall not be liable for any problems resulting from any misrepresentation in the submission and/or in the contents of the medical certificate submitted.

 

12. Pregnant Passengers
All pregnant passengers must present a medical certificate dated at least 5 days within the departure date attesting to their fitness to undertake sea travel and will be required to sign a waiver upon check-in. Trans-Asia Shipping Lines, Inc. reserves the right to deny check-in. The passenger confirms the authenticity of the said medical certificate and the truthfulness of the contents thereof; otherwise, Trans-Asia Shipping Lines, Inc. shall not be liable for any problems resulting from any misrepresentation in the submission and/or in the contents of the medical certificate submitted.

 

13. Refund and Revalidation
Ticket may be revalidated (rescheduled) or refunded at the issuing outlet or at any Cebu and Provincial Main or satellite office provided that the lawful passenger named herein must present his printed itinerary receipt or E-ticket and a photocopy of a valid ID (with picture) as proof of his identity, and that the ticket has not yet expired or lapsed sixty (60) days from the departure date.

 

Ticket revalidation is subject to applicable surcharge.
Revalidation surcharge must be paid in cash and can be done only once per ticket. Revalidated tickets are subject to fare rates prevailing at the time of revalidation.

 

Ticket refund is subject to applicable surcharge.
No partial refunds shall be given for tickets with room rates. Refunds are released upon surrender of all issued tickets for a particular room.

 

14. Uncompleted Voyage
In the event the vessel cannot continue or complete the voyage for any cause whatsoever, Trans-Asia Shipping Lines, Inc. reserves the right to cancel the trip and refund the passenger the unused cost of his ticket, or to revalidate the ticket for another schedule or destination. Web fees and other web-related fees are not refundable.

 

15. Change of Schedule
Sailing schedule of the vessel is not guaranteed and may change between the date of purchase and the date of travel. Carrier will exert reasonable efforts to notify the affected passengers of any change or postponement of the sailing schedule, but the Carrier will not be liable in any way for any loss or damage that occurred or may occur, as a result of any such change or postponement.

 

16. Diversions
Carrier may divert any trip to any port other than the port of destination if it is unable to proceed for reasons beyond its control. The Carrier will endeavor to the extent possible and practicable to, but does not guarantee it will, arrange suitable alternative means of transportation to enable the affected passengers to reach the port of destination.

 

17. Cancellation and Delays
Trans-Asia Shipping Lines, Inc. reserves the right to cancel, terminate, or delay any departing vessel or suspend the operation at any time after a reservation has been made.

 

18. Connecting Trips
Trans-Asia Shipping Lines, Inc. is not responsible for any connecting trips of the passenger or for any misconnection arising from any delay or cancellation of the scheduled trip.

 

19. Change of Vessel
Trans-Asia Shipping Lines, Inc. reserves the right to deploy another vessel instead of that originally assigned without prior notice. Affected accommodations will be automatically downgraded should there be no available accommodations and the fare difference shall be refunded to the passenger. In the event that all accommodations are fully booked, passenger agrees to be refunded in full.

 

20. Change of Fare
Fare rates are subject to change at any time without prior notice.

 

21. Unauthorized Alterations
Any alteration on the ticket shall render it null and void.

 

22. Send-off Visitors
A passenger’s send-off visitors are not allowed to board the vessel. Any passenger who violates this rule shall assume any liability that may arise from unauthorized boarding by his send-off visitors.

 

23. Modification of Terms and Conditions
Carrier reserves the right to change this agreement at any time by revising the terms and conditions herein. User is responsible for regularly reviewing these terms and conditions. Continued use of this website following any such changes shall constitute the User’s acceptance.

 

24. Government-Mandated Discounts
The following are government-mandated discounts:
0. Student discount – 20% off on the regular basic fare applicable to 2nd class non-aircon, 2nd class aircon, Tourist, and Tourist Deluxe accommodations.
1. Senior citizen discount – 20% off on the regular basic fare.
2. Minor discount – special rates.
3. Infant discount – special rates.

 

25. Venue of Action
Any court action arising from a transaction shall be subject to the jurisdiction of the proper courts in the City of Cebu to the exclusion of any other court. Trans-Asia Shipping Lines, Inc. will accept formal and legal notices or documents only at its registered address in Cebu City, Philippines.
